While formerly only retailers with brick-and-mortar stores in a state were required to collect sales tax, New York has enacted a law which forces etailers to collect tax, if they have affiliates which redirect traffic to their sites (e.g., Amazon Affiliates).

Every day thousands and thousands of New York residents drive across the bridges to the big shopping malls in northern New Jersey to purchase clothing and other items on which that state charges no sales tax. This sort of tax avoidance doesn't seem terribly different from buying items from an on-line retailer. It is impractical (and probably unconstitutional) for New York to set up border checkpoints to collect tax on New Jersey purchases, and it is probably just as impractical (and just as unconstitutional) for them to tax on-line commerce. Regulation of interstate commerce is reserved to the Federal government.
My guess is that New York will only collect from those businesses that are headquartered in that state, or who have a substantial physical presence there. The bigger on-line retailers will fight this in federal court, and they will win.

New York has a history of collecting illegal taxes and then when they finally lose in court years later, they claim they can not afford to pay the taxes back.

Just what the taxpayers need....additional taxes to pay. As long as the voters continue to put in office these imbeciles, we will continue to be taxed to death.

We can expect a lot of new taxes as the sconomy slows but government continues to expand.
A quarter of the new jobs created last year were government jobs. Someone has to pay these people to sit around.

Harbeas, Justice4All and Rodd716 are right. All those people driving to NJ to shop are depriving New York of revenue and jobs. New taxes are bad for the economy. Period. While we're not in a recession, the economy is fragile. Just wait until Obama gets in and starts spending and taxing. We could see something most of us haven't seen in our lifetimes, a true depression. It spooks the hell out of me. I'm always so puzzled why people can think clearly enough to vote in their own self interest.
